1. Agreement
These Terms and Conditions govern your use of Companio’s mobile apps, websites, caregiver dashboard, calling features, and related services, operated by Tilosia, LLC.
By creating an account, starting a subscription, inviting a caregiver, adding a loved one, or using Companio, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use Companio.
2. What Companio does
Companio is a companion calling and caregiver insight service for families supporting aging loved ones.
Companio may provide scheduled check-in calls, caregiver-initiated calls with an agenda, medication reminders, daily summaries, mood notes, wellness context, Apple Watch or HealthKit integrations, and support for multiple loved ones and caregivers.
Features may change, be added, be limited, or be discontinued over time.
3. Not medical care or emergency service
Companio is not a medical device, medical provider, emergency response service, medication management system, or substitute for professional care.
Companio does not diagnose, treat, cure, prevent, or monitor any disease or medical condition. Information shown in Companio is for supportive family awareness only.
If you believe someone is in immediate danger, contact emergency services or a trusted local caregiver directly. Do not rely on Companio for emergencies.
4. Eligibility and accounts
You must be at least 18 years old to create a caregiver account or purchase a subscription.
You are responsible for keeping your login credentials secure and for activity under your account. Notify us promptly if you believe your account has been compromised.
5. Consent and caregiver responsibilities
If you add a loved one, schedule calls, enter medication information, connect health data, invite caregivers, or request summaries, you represent that you have the necessary permission and authority to do so.
- Provide accurate information.
- Use Companio only with appropriate consent.
- Invite only trusted caregivers.
- Review summaries and follow up when something matters.
- Comply with laws that apply to calls, recordings, consent, privacy, and health information in your location.
Where call recording, transcription, or summary features are enabled, you are responsible for ensuring all required consents have been obtained unless Companio handles that consent flow directly.
6. Calls, agendas, summaries, and AI
Companio may place scheduled calls and caregiver-initiated calls. Caregivers may provide an agenda, such as asking about medication, mood, meals, pain, appointments, or general wellbeing.
Companio uses AI and automation to conduct conversations and generate summaries. AI can make mistakes. Summaries may be incomplete, inaccurate, delayed, or misinterpreted.
You should not rely on Companio as the only source of truth for important health, safety, medication, or emergency matters.
7. Medication check-ins
Companio may help remind a loved one about medication and ask whether medication was taken. This feature is for family awareness and convenience only.
Companio does not verify that medication was actually taken, does not replace a medication management system, and does not provide medical advice.
For critical medication needs, use appropriate professional, clinical, or caregiver-managed systems in addition to Companio.
8. HealthKit and health data
Companio may display health data from Apple Health, HealthKit, Apple Watch, or other supported sources after permissions are granted.
Health data may include heart rate, steps, sleep, calories, exercise, ECG, and other supported metrics. Availability depends on device compatibility, permissions, operating system support, and platform rules.
Companio does not use HealthKit data for advertising, marketing, or data mining, and does not sell HealthKit data.
Health data in Companio is not medical advice and should not be used for emergency decisions or diagnosis.
9. Subscriptions, trials, and billing
Companio is offered as a subscription. Current pricing is $9.99 per month or $99 per year after a 7-day free trial, unless the app store, website, or checkout screen shows a different price or offer.
Subscriptions may be billed through Apple App Store, Google Play, or another payment provider. Their billing terms, cancellation rules, refund rules, and subscription tools may apply.
Unless canceled before the end of the trial, your subscription may automatically renew and you may be charged. Manage or cancel your subscription through your app store subscription settings.
Prices, free trials, and features may change. Any changes will be shown where required before they take effect.
10. Acceptable use
You agree not to misuse Companio. You may not:
- Use Companio without appropriate consent.
- Enter false, misleading, or unauthorized information.
- Use Companio to harass, abuse, deceive, exploit, or harm anyone.
- Attempt to reverse engineer, disrupt, overload, scrape, or interfere with Companio.
- Use Companio for unlawful, emergency, clinical, or regulated medical purposes unless we expressly agree in writing.
- Share account access with unauthorized people.
- Use Companio in violation of app store rules, telecommunication laws, privacy laws, or call recording laws.
11. Ownership and feedback
Companio, including the app, website, design, software, trademarks, content, and related technology, is owned by Tilosia, LLC or its licensors.
You may use Companio only as allowed by these Terms. We do not transfer ownership of Companio to you.
If you send feedback, suggestions, or ideas, we may use them without restriction or compensation to you.
12. Third-party services
Companio may rely on third-party services for calling, AI processing, transcription, hosting, app distribution, payments, authentication, analytics, health-data integrations, notifications, and customer support.
Third-party services may have their own terms and privacy policies. We are not responsible for third-party services that we do not control.
13. Suspension and termination
You may stop using Companio at any time. You can request account deletion by contacting us or using in-app tools where available.
We may suspend or terminate access if we believe you violated these Terms, created risk, failed to pay, misused the service, or if required by law.
14. Disclaimers
Companio is provided “as is” and “as available.” We do not guarantee that Companio will be uninterrupted, error-free, accurate, secure, or available at all times.
We do not guarantee that calls will always connect, summaries will always be correct, medication check-ins will always occur, health data will always sync, or issues will always be detected.
To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing or usage of trade.
15. Limitation of liability
To the fullest extent permitted by law, Tilosia, LLC and its officers, employees, contractors, partners, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities.
To the fullest extent permitted by law, our total liability for any claim related to Companio will not exceed the greater of the amount you paid for Companio in the three months before the claim or USD $100.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
16. Governing law and disputes
These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law rules.
Any disputes will be resolved in the courts of Suffolk County, New York, unless an arbitration clause is agreed or consumer law requires a different forum.
17. Changes
We may update these Terms from time to time. If we make material changes, we will provide notice through the app, website, email, or another reasonable method.
Your continued use of Companio after changes take effect means you accept the updated Terms.
